INTERPRETATION

In these Conditions the following words shall have the following meanings

The Buyer/You:	The person(s), firm or Company who purchases the Goods from the Company
The Company/We:	Paintball Store Shop Limited
Contract:	Any Contract between the Company and the Buyer for the sale of the Goods, incorporating these Conditions
Goods:	Any goods agreed in the Contract to be supplied to the Buyer by the Company (including any part or parts of them)

SHIPPING AND HANDLING AND DELIVERY:

Although every effort is made to ensure that goods arrive in good condition, the Company cannot be held responsible for the actions of the courier used. Any damages must be signed ‘Damaged’ on receipt for delivery and claimed for in accordance with the carrier’s terms and conditions. Due to the fragile nature of paintballs the Company will be unable to make any claim on the Buyers behalf for any breakages suffered. The Buyer upon placing the order accepts the risk of damage.

All orders must be delivered to the cardholders address, address checks can and will take place, so to avoid unnecessary delay please ensure the correct address is given. Delivery to PO boxes is not possible.

Pyrotechnics, in any form, will not be delivered.

Co2 or Air bottles, as used for containing marker propellants, will be delivered non-filled.

Although every effort is made to keep our stock as up to date as possible, we will occasionally run out of stock. This is beyond our control. We will however inform you of this shortage by e-mail or by telephone call and will advise you on the status of the order after 5 working days of the Buyer requesting an order and we will wait till the full order can be shipped unless advised otherwise by the Customer.

Delivery shall be within a reasonable time.

POSTAGE COSTS

Postage costs are calculated on the combined weight of your order. This cost is calculated at the checkout shipping stage of placing your order. You can check the cost of the postage at any time, by logging into your account and following the checkout proceedure. You do not have to make a payment before the postage cost is calculated.

RISK

The Goods are at the risk of the Buyer from the time of delivery.

Ownership of the Goods shall not pass to the Buyer until the Company has received in full (in cash or cleared funds) all sums due to it in respect of:

(a) The Goods and
(b) all other sums which are or which become due to the Company from the Buyer on any account.

The Company shall be entitled to recover the Goods notwithstanding that ownership of any of the Goods has not passed from the Company.

PRICE

Unless otherwise agreed by the Company in writing the price of the Goods shall be the price set out in the Company’s price list published on the date of delivery or deemed delivery

The price of the Goods shall be exclusive of any value added tax and allcosts or charges in relation to reloading, unloading, carriage and insurance all of which amounts the Buyer will pay in addition when it is due to pay for the Goods.

The company reserves the right to make any adjustment to the price to take account of any increase in the company`s suppliers prices, or the imposition of any new taxes or duties, or if due to any error or omission the price published for the goods on our website is wrong.

PAYMENT

Payment for the price of the Goods is due when the Goods are ordered. Payment can be made by Visa, Mastercard and Switch

Time for payment shall be of the essence.

No payment shall be deemed to have been received until the Company has received cleared funds and the price quoted will be inclusive of VAT and prices will always be quoted in pounds sterling

All payments payable to the Company under the Contract shall become due immediately upon termination of this Contract despite any other provision

The Buyer shall make all payments due under the Contract without any deduction whether by way of set off, counterclaim, discount; abatement or otherwise unless the Buyer has a valid court order requiring an amount equal to such deduction to be paid by the Company to the Buyer.

LIMITATION OF LIABILITY

The following provisions set out the entire financial liability of the Company (including any liability for any acts or omissions of its employees, agents and sub-contractors) to the Buyer in respect of:

(a) any breach of these conditions; and
(b) any representation, statement or tortious act or ommission including negligence arising under or in connection with the Contract.

Nothing in these conditions excludes or limits the liability of the Company for the death or personal injury caused by the Company’s negligence or Fraudulent misrepresentation.

FORCE MAJEURE

The Company reserves the right to defer the date of delivery or to cancel the Contract or reduce the volume of the Goods ordered by the Buyer (without liability to the Buyer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control of the Company including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riots, civil commotion, fire, explosion, epidemic, lock –outs, labour disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable supplies.

GUARANTEE’S AND WARRANTIES:

All of our products are covered under the manufacturer warranty and the Company will endeavour to transfer to the Buyer the benefit of any Warranty or Guarantee given to the Company.

RETURNS POLICY

Under the European Distance Selling Regulations the Buyer has the right to cancel your order for any item purchased on this web site for a full refund within 14 days of delivery.

To cancel the Buyer must e-mail or write to the Company within seven days of delivery of your item(s) quoting your order number. The Buyer, are obliged to take reasonable care of the items and return them in an unused condition with the original packaging and accompanied by the original receipt. The Buyer is obliged to return the goods at their own cost within 30 days; the Company will not refund this cost. The Buyer is responsible for the goods until they are back in the possession of the Company, the Buyer must claim for any damages caused on the return, from the courier used. If the goods are not returned in an unused condition then the right to a full refund is forfeited.

When returning items that are deemed to be faulty, the Buyer must contact the Company by telephone, prior to sending the articles back and obtain instructions and an authorised return reference from the sales staff. Second hand items, or items that are described as seconds, are not deemed as being faulty for the imperfections disclosed at the time of sale.

The Company shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow manufacturers instructions, misuse, alteration or repair of the goods (other than that done by our staff).

In other instances we will consider an exchange or credit note provided that the goods are returned promptly; in their original condition and with the original receipt.
